End User License Agreement

1. Agreement to Terms

This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "you") and Sunnah Match ("Company," "we," "us," or "our"). This Agreement governs your use of the Sunnah Match mobile application and website (collectively, the "Service"). By downloading, installing, accessing, or using the Service, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use the Service.

2. License Grant

2.1 Limited License

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on your personal mobile device or computer solely for your personal, non-commercial use in connection with finding a marriage partner in accordance with Islamic principles.

2.2 License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble the Service
• Distribute, sublicense, rent, lease, or lend the Service to any third party
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the Service for any illegal, unauthorized, or commercial purpose
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use any automated means (bots, scrapers, etc.) to access or collect data from the Service
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks

3. User Accounts and Eligibility

3.1 Age Requirement

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement.

3.2 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Account Security

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Acceptable Use and Conduct

4.1 Purpose of Service

The Service is intended solely for individuals seeking marriage in accordance with Islamic principles. You agree to use the Service only for this lawful purpose and in a manner consistent with Islamic values and teachings.

4.2 Prohibited Conduct

You agree NOT to use the Service to:

• Engage in any fraudulent, deceptive, or misleading activity
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Harass, abuse, threaten, or intimidate other users
• Upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Post or share photographs or images (in accordance with our no-pictures policy)
• Solicit money or personal information from other users
• Use the Service for any commercial purpose or to promote any business or service
• Violate any applicable laws, regulations, or third-party rights
• Engage in any activity that is contrary to Islamic principles or values
• Create multiple accounts or use the Service if you have been previously banned

4.3 Profile Information

You agree to provide truthful and accurate information in your profile. Misrepresentation of your identity, marital status, or other material facts is strictly prohibited and may result in immediate termination of your account.

4.4 Islamic Values

As a service dedicated to helping Muslims find marriage partners in a halal manner, all users are expected to conduct themselves in accordance with Islamic principles. This includes maintaining modesty, honesty, and respect in all interactions with other users.

5. Subscription and Payment Terms

5.1 Subscription Plans

The Service may offer various subscription plans with different features and pricing. Details of available plans are provided within the Service. By purchasing a subscription, you agree to pay the applicable fees.

5.2 Payment Processing

All payments are processed through third-party payment processors. You agree to provide accurate and complete payment information and authorize us to charge the payment method you provide for the applicable fees.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee unless you cancel your subscription through your account settings or the applicable app store.

5.4 Cancellation

You may cancel your subscription at any time through your account settings or through the app store where you made the purchase. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

5.5 Price Changes

We reserve the right to change subscription fees at any time. We will provide you with advance notice of any price changes. If you do not agree to the new pricing, you may cancel your subscription.

5.6 Refund Policy

All sales are final. We do not provide refunds except as required by law or as expressly stated in this Agreement. If you purchased your subscription through the Apple App Store or Google Play Store, refunds are subject to their respective refund policies.

6. Intellectual Property Rights

6.1 Ownership

The Service and all content, features, and functionality (including but not limited to all information, software, text, displays, images, audio, video, and the design, selection, and arrangement thereof) are owned by Sunnah Match, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 Trademarks

The Sunnah Match name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Sunnah Match or its affiliates or licensors. You may not use such marks without our prior written permission.

6.3 User Content License

By submitting content to the Service (including profile information, messages, and other communications), you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and providing the Service.

7. User-Generated Content and Harmful Content Policy

7.1 User-Generated Content

The Service allows users to create and submit content, including profile information, messages, and other communications ("User-Generated Content" or "UGC"). You retain ownership of your UGC, but by submitting UGC to the Service, you grant us the license described in Section 6.3 above.

7.2 Responsibility for UGC

You are solely responsible for all UGC you submit to the Service. You represent and warrant that:

• You have all necessary rights and permissions to submit the UGC
• Your UGC is truthful, accurate, and not misleading
• Your UGC does not violate any third-party rights, including intellectual property, privacy, or publicity rights
• Your UGC complies with all applicable laws and regulations
• Your UGC does not violate these Terms or our community standards

7.3 Zero Tolerance for Harmful UGC

Sunnah Match maintains a zero-tolerance policy for harmful, abusive, or inappropriate User-Generated Content. We are committed to providing a safe, respectful, and Sharia-compliant environment for all users. The following types of harmful UGC are strictly prohibited and will result in immediate content removal and may lead to account suspension or permanent ban:

• Harassment and Abuse: Content that harasses, bullies, threatens, intimidates, or abuses other users or any individual
• Hate Speech: Content that promotes hatred, discrimination, or violence based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic
• Sexual Content: Sexually explicit, pornographic, or sexually suggestive content, including intimate conversations, solicitations, or images
• Violence and Threats: Content that promotes, glorifies, or threatens violence or physical harm against any person or group
• Fraud and Scams: Fraudulent, deceptive, or misleading content, including false identities, catfishing, financial scams, or phishing attempts
• Illegal Activities: Content that promotes, facilitates, or solicits illegal activities or violates any applicable laws
• Self-Harm: Content that promotes, encourages, or glorifies self-harm, suicide, or eating disorders
• Spam and Manipulation: Spam, malicious links, viruses, or attempts to manipulate or exploit the Service or other users
• Un-Islamic Content: Content that contradicts Islamic principles, mocks Islamic teachings, or promotes behavior contrary to the Sharia
• Unauthorized Images: Any photographs, videos, or images, in accordance with our strict no-pictures policy
• Personal Information: Unsolicited sharing of personal or private information about yourself or others (doxxing)
• Intellectual Property Violations: Content that infringes copyrights, trademarks, or other intellectual property rights
• Impersonation: Content that impersonates or falsely represents affiliation with any person or entity
• Minor Safety: Any content involving, depicting, or targeting minors in an inappropriate manner

7.4 Content Monitoring and Moderation

We reserve the right, but have no obligation, to monitor, review, screen, edit, or remove any UGC at any time and for any reason, without notice. We may use automated tools, manual review, and user reports to identify prohibited content. However, we do not pre-screen all UGC, and you acknowledge that you may be exposed to content that is inaccurate, offensive, or otherwise objectionable.

7.5 Reporting Harmful Content

If you encounter any UGC that violates these Terms or that you believe is harmful, abusive, or inappropriate, please report it to us immediately at [email protected] or through the reporting features within the Service. We take all reports seriously and will investigate and take appropriate action, which may include content removal, user warnings, account suspension, or permanent ban.

7.6 Consequences for Violating Content Policy

Violations of our UGC policy may result in the following actions, at our sole discretion:

• Removal of the offending content
• Formal warning
• Temporary suspension of account privileges
• Permanent ban from the Service
• Reporting to law enforcement authorities (in cases of illegal content or activities)
• Legal action to recover damages or seek injunctive relief

We reserve the right to take immediate action without prior notice when we determine that UGC poses a risk to user safety, violates the law, or threatens the integrity of the Service.

7.7 No Endorsement of UGC

We do not endorse, support, represent, or guarantee the accuracy, completeness, truthfulness, or reliability of any UGC. Any reliance on UGC is at your own risk. Views expressed in UGC do not necessarily reflect the views of Sunnah Match.

7.8 Backup and Preservation

We are not responsible for backing up or preserving your UGC. You are solely responsible for maintaining copies of any UGC you wish to retain. We may delete UGC at any time, including upon account termination or deletion.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Sunnah Match. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

9. Disclaimers and Limitations of Liability

9.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

9.2 No Guarantee of Results

We do not guarantee that you will find a suitable marriage partner through the Service. The Service is a platform to facilitate connections, but the success of any relationship depends on many factors beyond our control.

9.3 User Responsibility

You are solely responsible for your interactions with other users. We do not conduct background checks on users. You should exercise caution and good judgment when communicating with other users and should never provide financial information or send money to other users.

9.4 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUNNAH MATCH, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.

9.5 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Sunnah Match, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement or your use of the Service.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature within the Service.

11.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to your breach of this Agreement. Upon termination, your right to use the Service will immediately cease.

11.3 Effect of Termination

All provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Dispute Resolution

12.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to this Agreement or the Service, you agree to first contact us to attempt to resolve the dispute informally. Please send your concern to [email protected].

12.2 Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to this Agreement or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and judgment on the arbitration award may be entered in any court having jurisdiction.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

12.4 Exceptions

Notwithstanding the above, either party may seek equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the United States and the state in which Sunnah Match is incorporated, without regard to its conflict of law provisions. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the federal or state courts located in that jurisdiction.

14. Changes to This Agreement

We reserve the right to modify this Agreement at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such notification constitutes your acceptance of the modified Agreement. If you do not agree to the modified Agreement, you must stop using the Service.

15. General Provisions

15.1 Entire Agreement

This Agreement, together with our Privacy Policy and any other legal notices or terms published by us on the Service, constitutes the entire agreement between you and Sunnah Match regarding your use of the Service.

15.2 Severability

If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer this Agreement or any of your rights or obligations under this Agreement without our prior written consent. We may assign this Agreement without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

15.6 Export Control

You agree to comply with all applicable export and import control laws and regulations in your use of the Service.

16. Apple App Store Additional Terms

If you access the Service through the Apple App Store, the following additional terms apply:

• This Agreement is between you and Sunnah Match only, not with Apple Inc. ("Apple"). Sunnah Match, not Apple, is solely responsible for the Service.
• The license granted to you is limited to a non-transferable license to use the Service on any Apple-branded device that you own or control as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to furnish any maintenance and support services with respect to the Service.
• Apple is not responsible for addressing any claims you have or any claims of any third party relating to the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing any claims relating to the Service or your possession and/or use of the Service.
• Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
